No, it would make all the smartphone users with 3G phones pay the same as the EVO users.

My question is what if you are already under contract with, say, a BlackBerry, and the device goes on the fritz, so you activate a spare device you already have.
Does the $10 charge apply then? I would think so since the press release said "or activate another smartphone" I'm attempting to find out though. |

I interpret that if you activate a phone, the policy is triggered

I have received confirmation from Sprint that there is 1 exception to this new data plan.
If you have a smartphone that was originally activated prior to 1/31/11, and the device is replaced under warranty or insurance, then the $10 charge does NOT apply. My son found the exception here in the Sprint Community pages: Sprint Community: Plans: What's there to know about the $10 Smartphone Premium Data Add-on? ...and Sprint confirmed it for me. |
