Sprint adding $10/mo "premium data" to all smartphones

Interesting title to a press release: Smartphones Drive Wireless Data Explosion

When it should read: Sprint to add $10/mo to all smartphones

Here's the press release:

Sprint Newsroom | Smartphones Drive Wireless Data Explosion

A couple of things that jump out:

Quote:

Sprint will increase its postpaid rates by applying a $10 per month Premium Data add-on charge to activations of smartphones beginning Jan. 30.
and

Quote:

Existing Sprint smartphone customers are not affected unless they upgrade to or activate another smartphone.
This $10/mo plan is also not eligible for any discounts you may receive on your plans.

So, will this be added on to the additional $10 that EVO users pay?

No, it would make all the smartphone users with 3G phones pay the same as the EVO users.

No complaints here then.

I guess anyone looking to move to Sprint or upgrade should do so before the 30th!

My question is what if you are already under contract with, say, a BlackBerry, and the device goes on the fritz, so you activate a spare device you already have.

Does the $10 charge apply then? I would think so since the press release said "or activate another smartphone"

I'm attempting to find out though.

I interpret that if you activate a phone, the policy is triggered

I have received confirmation from Sprint that there is 1 exception to this new data plan.

If you have a smartphone that was originally activated prior to 1/31/11, and the device is replaced under warranty or insurance, then the $10 charge does NOT apply.

My son found the exception here in the Sprint Community pages:

Sprint Community: Plans: What's there to know about the $10 Smartphone Premium Data Add-on?

...and Sprint confirmed it for me.
