I wouldn't get my device replaced because of this issue. I am going to say that it has something to do with the RIM headphones that come with the phone, they must be causing a short or something in the device. I have been using my cheap $10 headphones ever since, I have no problem at all, because the cheap buds do not have microphone on them, therefore they never trigger the mic/headset switch when I plug them in, which won't get stuck after pulling them out.
