Default Intellectual property or customer abuse

It is ATT (not the developer of IP) not RIM (the developer) that is causing users to unbrand their phones. Only ATT disabled network mode selection to force users onto their 3G network which is not ready. It is clear that the Bold has a huge problem switching between 3G and 2G causing "failed call", dropped calls and poor battery life. Everyone I know in NY has huge problems with dropped calls.
When I bought my Bold from ATT, they didn't tell me that they would force me to use only 3G. iPhone users are not prevented from switching. Given these facts, it is hard to blame us for utilizing available methods to obtain the software that RIM developed for us.
RIM is a great company and the Bold is a great product. I just want to use their device as it was intended. I should be able to select the best network for me until the ATT 3G network is built out or until RIM solves the 2G/3G switching issue.
