Multiple contact lists with the same name

Just got a new Bold (which is great) but I have a problem with contact lists. I have two of them and they have the same name, which is "Desktop"
They created themselves and come back when I wipe the device.
One has all of my real contacts in and the second has anything new I create on the device.
Problem is that I can't change which sync's with my Notes. So all I get is the one with new entries. Even tried one way syncs etc.
Means that my Notes keeps on emptying my contacts.
Contacts are not supposed to sync wirelessly on our BES server but they certainly do on the first set up.
Got any ideas?
PC. new to posting on the forum but have been getting tips from it for years so hoping you can help here.
