Default Buying an unlocked BB and using it with AT&T but not with a data plan?

Hi. I'm considering buying an unlocked Black Berry 8800. I would like it more as a PDA then an a internet phone to be honest. Calling, texting, and PDA aspects are what are most important. Also the phone just looks really nice. Working in IT it does sort of look a bit weird I don't have a phone like this. Anyway that isn't a big reason why I want to pick this up.

My issue is using the phone in general. I'm out of contract with AT&T.

Can I simply put my current AT&T sim card into an unlocked BB and use it and it's features (save for the data elements)?

Or would AT&T detect that the sim card is now in a BB and require me to use a data plan or at worse add one themselves?

Could I still do texting on this phone if there is no data plan but if I have texting on my current cell plan? Texting is one of the things I do and receive a lot of.

If this isn't possible with a BB can anyone suggest any phones that would be similar to a BB but not require a data plan to use?

I don't really need a data plan and can't justify paying the extra money for one to be honest. I'm using a computer all day for the most part either desktop or laptop as I travel around buildings in my district. I have wifi setup at home so if I'm away from my computer I might use my iPod Touch to access my e-mail.

Thanks.

This actually brings up another issue I've been wondering about. If they were to simply add the plan how is that legal? Doesn't that require an actual agreement between the parties?

So they can simply detect your sim card is in a different phone and, regardless of the previous agreement setup up flip the switch on a service and start charging you for something that you wouldn't have been able to utilize and wasn't active before?
