If it makes any difference to this argument, the company that owns Blackberryforums.com (which is owned by the Tom Glogowski, the founder of this site) was incorporated back in late 2006.
Seems to me anyone using blackberryforums.anything is infringing...but I'm no lawyer.
And with that, I'm closing this no-longer-useful thread.
