In your software config, set the application control policy to <none> at the "Application Software" level, then put the App control policy at the actual DST patch level to be whatever you want.
Resend the IT policy, once applied, reset the device, it should try again and this time work.
EDIT: If you look in the handheld logs, you'll see a bunch of tzotapatcher lines. The last hex value on the lines are the ones you want to look at....it'll go something like:
x01 <- Patch starting
x10 <- Making MDS connection
x03 <- Downloading Patch
x06 <- Patch Downloaded
x8D <- Error installing patch tx error

BlackBerry that has all the status/error codes.
for dowlingm, the patch version is 2.3 as noted in his list of error codes. it's a table looking like this:
