Almost wants to make me march down to the local AT&T or Apple store, buy 10, then turn around and sell each for a $100 profit.

I haven't tried activating one, but from what I have been told, the activation and contract sign up happens when you get home from the Apple store and hook it up to iTunes. That's probably wrong, though, as everyone and their brother would just be buying these and selling them on the open market for a profit.

Yup, you don't need to sign a contract at the store. All you do is pay $399, bring it home, and you can do whatever you want with it, unlock it, use it as an ipod, whatever you want. You don't have to sign the contract.

Yeah, I remember Apple for a while not accepting cash and limiting the purchases to something like two.

I guess with Apple's activation scheme, they intended for you to have to go through iTunes, so it shouldn't matter if no contract was signed at the point of sale. But they, of all people, should know that those who want to get around DRM or any other computer limitations will do so in a matter of days.
